Good afternoon,
I
want to make a quick statement about an operation conducted on Sunday. My Deputies, along with assistance from Calhoun County, Fordyce Police Department, Arkansas Game & Fish, 13th Judicial Drug Task Force, and the Arkansas Department of Community Corrections, visited 27 residences of people actively on probation or parole. Of those 27 searches, 28 suspects were arrested for various crimes, mostly drug and firearm offenses. Two sex offenders were arrested for non-compliance or failure to register. There were numerous drugs seized during this operation, along with guns and ammunition. Methamphetamine and marijuana seemed to be the drug of choice. I want to recognize everyone involved in this operation
Let me make myself clear, I promised the voters/residents of this county I would do everything to combat the drug problems going on here. I have seen some social media posts saying the operation was illegal. I encourage them to go back and use their Google lawyer degree and go to A.C.A. 16-93-106. I will post it below to save some time for those accusing us of doing illegal searches. I've only been in law enforcement for 40 years and would never do anything illegal to violate someone's civil rights. If you have a problem with us seizing illicit drugs and guns from the streets, then YOU are part of the problem! If you want to continue violating the law, you have two options: STOP or MOVE from our county.
A.C.A. 16-93-106
As a condition of my supervised probation, parole, or post-release supervision, I agree to allow any Division of Community Correction officer or any certified law enforcement officer to conduct a warrantless search of my person, place of residence, motor vehicle, or other real or personal property, including without limitation a cellular or electronic device under my control or possession, at any time, day or night, whenever requested by the Division of Community Correction officer or certified law enforcement officer.
I understand that a warrantless search based on this waiver must be conducted reasonably but does not need to be based on a clearly expressed suspicion that I am committing or I have committed a criminal offense.
Arkansas law code annotated §16-93-106 requires this waiver to be signed by a person placed on supervised probation, released on parole, or under post-release supervision under this section as a condition of his or her community supervision.
